Terms of Service
These Terms of Service (“Terms”) govern your access to and use of ReelTemps (the “Service”), operated by ReelTemps (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What ReelTemps is
ReelTemps packages publicly available satellite and buoy data — from sources including NOAA, NASA JPL, the EU Copernicus Programme and the NDBC buoy network — into sea-surface temperature, chlorophyll, cloud-free and true-color charts, with tools to view and plan around them. We build a model and presentation on top of that public data; we are not the originator of the underlying measurements.
2. Nature and accuracy of the data
The Service is provided for general informational and recreational purposes. You acknowledge and agree that:
- The data is derived from third-party public sources that we do not control and cannot guarantee.
- Satellite observations are estimates. Values may be affected by clouds, sensor gaps, processing, timing, and modeling, and may differ materially from actual in-water conditions.
- Water temperature and other conditions you measure yourself — for example with a transducer on your vessel — may not match what the Service shows. Measured, modeled, and satellite-derived values can and do differ.
- We make reasonable efforts to present the best available data, but we do not warrant its accuracy, completeness, timeliness, or fitness for any particular purpose.
3. Accounts
You are responsible for your account credentials and for all activity under your account. You must provide accurate information and be old enough to form a binding contract in your jurisdiction. Do not share your account or resell access.
4. Subscriptions, billing and refunds
- ReelTemps is sold as an annual membership at the price shown at checkout (currently $99.99/year), billed through our payment processor, Stripe.
- Unless stated otherwise, memberships renew automatically each year until cancelled. You can cancel anytime from your account; cancellation stops future renewals and takes effect at the end of the current paid term.
- Promotional or creator discount codes apply as described at checkout. Complimentary accounts, where offered, are provided at our discretion and may be changed or revoked.
- Except where required by law, payments are non-refundable. We may change pricing prospectively; changes do not affect the term you have already paid for.
5. Acceptable use
You agree not to misuse the Service, including by scraping or bulk-downloading data, reselling or redistributing it, reverse-engineering the Service, interfering with its operation, or using it unlawfully.
6. Intellectual property
The Service — including its software, design, compositing and presentation — is owned by ReelTemps and protected by law. The underlying public data remains subject to its originators’ terms. We grant you a limited, personal, non-transferable license to use the Service for your own fishing while your membership is active.
7. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will be accurate or available.
8. Limitation of liability
To the maximum extent permitted by law, ReelTemps and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, catch, fuel, property, or for personal injury, arising from or related to your use of — or inability to use — the Service or the data it presents, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Termination
We may suspend or terminate access for violation of these Terms or to protect the Service. You may stop using the Service at any time.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above; continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in California.
